Processing of Personal Data

Information on the processing of personal data provided pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as the “GDPR”) to representatives of customers and business partners of YATE.

Data Controller

YATE spol. s r. o., Company ID No. (IČ): 43226990, registered office at Brněnská 371, 500 06 Hradec Králové, registered in the Commercial Register maintained by the Regional Court in Hradec Králové, Section C, File No. 11717, registered on 11 November 1991 (hereinafter referred to as “YATE”), as the data controller, hereby informs you, in accordance with the GDPR, about the processing of your personal data and your rights.

Purposes of Processing Your Data

We process your personal data to the extent necessary for the following purposes:

  • fulfilling obligations arising from contracts;

  • fulfilling obligations arising from the terms and conditions of the services used;

  • fulfilling obligations arising from generally binding legal regulations;

  • maintaining contact details of representatives of customers and business partners;

  • sending commercial communications offering products and services;

  • providing a personalized approach to our online services;

  • ensuring the protection of our rights and legitimate interests.

In accordance with Act No. 480/2004 Coll., on Certain Information Society Services, YATE uses your contact details for the purpose of sending commercial communications containing offers based on automated decision-making, including profiling, until you express your objection to such use of your contact details. We are registered with the Office for Personal Data Protection – www.uoou.cz.

Sending Commercial Communications

YATE spol. s r.o. sends commercial communications to the email address you have provided, usually once a month. You can withdraw your consent by clicking the unsubscribe link in the footer of each email, or here.

We only retain information that you have provided to us yourself and send you only information that is relevant to your interests.

Your Data That We Process

YATE Retail Customer:

We maintain your first name, surname, title, address, telephone number and email address. If you have provided us with your bank account number, we also retain it in our database. We are legally obliged to keep all of this information as part of our accounting records.

YATE Business Partner:

We maintain your first name, surname, title, company address, business premises address (contact address), telephone number, email address, Company ID No. (IČO), VAT ID No. (DIČ) and bank account number.

Newsletter Subscriber:

We maintain your first name, surname and email address.

IN SPECIFIC CASES, WE PROCESS THE FOLLOWING INFORMATION.

Identification Data

In order to identify you unambiguously, we process personal data including: first name, surname, title, company and position within the company.

Data on Professional Focus

In order to provide you with information about our products and services that corresponds to your professional focus, we process personal data including: occupation, professional specialization and business questionnaires.

Data on the Use of Online Services

In order to tailor commercial information to your interests, we process personal data including: records of your use of our online services, IP addresses of devices and cookie identifiers.

List of Data Processors

We use additional processors to process your personal data.

The provider of the e-shop solution is ABRA Software a.s., Jeremiášova 1422/7b, 155 00 Prague 13, Company ID No. (IČ): 25097563, VAT ID No. (DIČ): CZ25097563, registered in the Commercial Register maintained by the Municipal Court in Prague, Section B, File No. 4475.

Accounting software: TANAKA, s.r.o., Karla Engliše 3201/6, 150 00 Prague 5 – Smíchov, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File No. 210888, Company ID No. (IČ): 63479320, VAT ID No. (DIČ): CZ63479320.

For sending commercial communications, we use the services of SmartSelling a.s., Netroufalky 797/5, Bohunice, 625 00 Brno, Company ID No. (IČ): 29210372, VAT ID No. (DIČ): CZ29210372, registered in the Commercial Register maintained by the Regional Court in Brno, Section B, File No. 7559.

Personal data may only be processed on behalf of YATE by processors on the basis of a personal data processing agreement.

Under certain conditions, your personal data may be disclosed to public authorities (the Police of the Czech Republic, courts, the Czech Tax Administration, etc.) as part of the exercise of their statutory powers.

Retention Period for Your Data

We store your personal data for the duration of the contract concluded between the company you represent and YATE, or for the duration of your registration for the use of YATE services.

After termination of the contractual relationship between the company you represent and YATE, or after termination of your registration for the use of our services, we continue to process your personal data only for the purposes and for the period for which we are legally required to retain such data under generally binding legal regulations.

If you have given us your consent to process personal data for the purpose of sending commercial offers, your personal data will be retained for 5 years from the date on which consent was given.

Once the retention period for your personal data has expired, or once the period during which we are legally required to retain the data has elapsed, we will anonymize or delete your personal data from our databases and systems.

Your Rights

We process your data transparently and fairly, in accordance with the GDPR and generally binding legal regulations. You have the right to access your personal data and the right to have it corrected. Where we process your data on the basis of your consent, you have the right to withdraw that consent at any time.

If you wish to withdraw your consent to the processing of your data and there is no other legal basis for processing your data, or if you object to receiving commercial communications, you have the right to request the erasure of your personal data or restriction of its processing.

You may exercise your right of access to your personal data and your other rights by submitting a written request by post to YATE's registered office or electronically to foam@yate.cz.

If you believe that the processing of your personal data is not being carried out properly, you may lodge a complaint with the Office for Personal Data Protection.
